Change of use of dwellinghouse (Use Class C3) to a House in Multiple Occupation (Use Class C4)

Clause 1(b)(iii) of the Schedule of Restrictive Covenants stipulates that “No trade or business shall be carried on upon the premises or any part thereof nor shall the same be used otherwise than as a private dwellinghouse”. This would appear to preclude the change of use from Class C3 to Class C4 and no evidence is provided that this covenant has been lifted. If consent were to be granted to this application, the City Council would be complicit in the breach of the covenant. No details are provided of the design or accommodation of the cycle parking and bin storage arrangements. We would urge refusal of consent pending clarification of these points.
